I sure hope that the clause that amateurs are not allowed to use equipment that can possibly be used on other bands is struck out. While this is an enforcement notice and isn't law, this may set legal precedence...
I don't own a Baofeng, but have been considering it as I don't have any dual band radios. I am currently using a modified Part 90/95 certified radio in the amateur bands, and that's why the wording is kind of alarming.

I own a few Baofang UV-5R radios as well as a Yeasu VX-6
The Yeasu is a great example of a "locked in" radio ....no law breaking here ......because you can't....ever!
The Baofang radios are just great radios. I love them. wide open . Fantastic . of course i obey the law i worked to hard to to get my ham license I am not going to do something stupid like broadcast/transmit over the NWS ! but just in case , it's nice to know the options there. I own a hand full of old HF radios that can transmit on a host of frequencies i cannot officially use ...........so i just don't

They do have a point... some unscrupulous people will look for radios that are "ham" radios and say "GO BUY THIS, 'HAM' RADIOS ARE UNLOCKED!!!" and then we have yet another person screwing with the airwaves...
I wish there was an easier way to deal with enforcement -- this is the ultimate issue. It would suck if there needs to be an enforcement tax added to deal with illegal use because FCC is underfunded to find these users.

BTW, there was this annoying brat that was transmitting garbage on one of the ham repeaters around here. Never identified as required by law. Based on what that person was transmitting, it was fairly clear the person was using... guess what... a baofeng...

Ok "Amateur Extra Licensee" What does a Baofeng owner transmit that identifies him as using a Baofeng?
Second: what on earth does the Baofeng have to do with a single rogue person on your repeater? any 2 meter radio can do that, it just costs a little more money. also you think it was a Just a "person" off the street,who knows enough to set frequency and offset and tone control(ctcss)? really??
Third : The Baofeng is able to transmit on a wide range of frequency's outside the normal 2 meter bands. with only 4 watts max i can't see where that additional feature would affect anyone transmitting legally (on the receiving or transmitting end).

Oh, it generated a quite unique tone that only Baofengs generate... one of those siren tones that is not a feature of other radios. It was on two linked, fairly busy 100w 70cm repeater and was interfering conversations and nets.
Fortunately the person has stopped being as obnoxious as they were. Used to be sending human generated noises, those siren tones, playing music, whole nine yards, stopping legitimate use of the repeater. Yes the person was smart enough to figure out the ctcss tones.
There was an effort to find that person but luckily the transmissions slowed down.

There is a "mic chirp" function that i have never used, it defaults to off and that's the way i like it. I have just never had anyone say "I can hear your on a Baofeng" and i really use mine...... a lot.... just about every day on the way to and from work.
As far as your troublemaker , they never stick around, a few days, a week at the most. there looking for attention and if they don't get it they get bored and go off to CB land or somewhere else to stir that up more than it already is..........."the cesspool of the airwaves....CB." how the mighty have fallen.

The hope is that they do leave and leave for good, but perhaps they go to other repeaters or frequencies.
The repeaters that were being bothered also have Echolink and were annoying those users as well. I think that person was there for a good month or two before things died down.
I'm still collecting radios... whether a Baofeng gets added or not I don't know...

Yeah that's a good one, albeit as crappy as they are, they do work...
But yeah, I rather deal with a person toying with a Baofeng than someone doing illegal rants on the radio...

I ordered an "illegal" baofeng (i.e. does not have the locks that FCC wants for Part 90 / Part 95 rules) for less than $20 new/shipped!
Going to be using it following part 97 rules, so this should be perfectly fine...

This baofeng is *nice* ...well sort of... I broke it already, and subsequently "fixed" it. Other than that, it's *so* much better than the other crappy radios I have, in terms of functionality. Now I just need to be able to attach it to an external antenna.
